COVID-19 Eviction Policy: Eviction Moratorium and Future Challenges

To address the public health crisis from COVID-19, the US Congress passed the CARES Act, which mandates a 120 day moratorium, from March 27th 2020, on evictions in rental properties that receive federal subsidies, including those properties with mortgages backed by the Government Sponsored Enterprises (GSEs) Fannie Mae and Freddie Mac. Based on our own research and the National Low Income Housing Coalition (NLIHC)’s National Housing Preservation Database, we have generated a database of all multifamily properties with 25 or more units in the City of Richmond, Henrico County, and Chesterfield County and indicate those properties that are covered under the federal moratorium. Even if a property is covered under the moratorium, enforcement remains a challenge given data limitations and the lack of access to counsel for tenants. This brief explores state and local policy responses to keep renters in their homes both during and after the immediate crisis of COVID-19.
